    The Firestorm
    Caused by Meuse's
    Motion to Reconsider Sua Sponte Dismissal of Bivens Claims
    ~~~~~
    This file takes a while to load.  But it is worth it!!
    It contains approximately 50 pages of  ".pdf" files
    -- real pleadings and scanned-in exhibits.
    The following documents are included in this file:
    • STF (America's Most Wanted) and FOX TV opposition to the motion to reconsider [filed 7/2/04, Paper 66]
    NOTE
    STF and FOX TV had not written about
    Bivens or federal claims
    in their original motion.
    That had been the judge's doing.
    • Meuse's Motion for Leave to Reply [filed 7/5/04, Paper 61]  GRANTED
    •
    • Reply to STF/AMW and FOX TV opposition to the motion to reconsider [filed 7/5/04, Paper 62]
    •
    • Meuse's Motion for Leave to File Supplement to Reply Brief  [filed 7/7/04, Entered 7/7/04, Paper 69] GRANTED
    • Supplemental Reply Brief [filed 7/7/04, Entered 7/7/04, Paper 71]
    • STF/AMW and FOX TV opposition to Meuse's Motion for Leave to Reply [filed 7/7/04, Entered 7/13/04, Paper 78]
    NOTE
    They attached three documents never-before-seen
    by Meuse or Barb
    or by the police detective or his captain
    (whom Barb had asked about the docs
    in Meuse's criminal trial)
    or by the state-court judges
    or even b the assistant district attorneys.
    They were documents only the FBI Special Agents claimed to have seen them
    The docs were:
  • a Criminal Complaint, USA v. Meuse
  • an UNsigned federal warrant
  • an affidavit by Special Agent Charles P. Kelly
  • The affidavit claims documents were attached to it,
    but those documents were not included in the attached exhibit.
    • One more Motion to Leave to File a Reply to STF/AMW and FOX TV 's Opposition  [filed 7/8/04, Entered 7/8/04, Paper 74] MOOTED
    •
    • Meuse's  Reply to STF/AMW and FOX TV opposition to Meuse's Motion for Leave to Reply  [filed 7/8/04, Entered 7/8/04, Paper 75
    •
    • One more opposition from STF/AMW and FOX TV, characterizing Meuse's arguments as "vitriol and ad hominem attacks" [filed 7/9/04, Entered 7/13/04, Paper 80]
    NOTES
    1.    STF/AMW and FOX TV did NOT want Barb to discuss the never-before-seen documents.
    2.    Barb deduced that the three documents were fabricated
    after the fact.
    3.    STF/AMW and FOX TV 's lawyers are with the firm which won the tobacco case and wants $$$$billions of dollars in legal fees from the City of Boston.
    • Barb did not get a chance to move to strike their last opposition before the decision was made.  All she
    • did was make deductions from the clearly fabricated documents STF/AMW and FOX TV relied upon to oppose Meuse's Motion to Reconsider
      • They tried to prove there was a federal case in October 2000 when there was not,
      •
      • they tried to prove there was an affidavit filed in November 2000 when there was not,
      •
      • they tried to prove there was a federal arrest warrant in November 2000 when there was not.
      Enough is enough!!!!!!   The lying, the deception, the corruption must stop.  Had the family court acted the many times Meuse asked, this fight today would not  have happened.
    Exhibit A to STF/AMW and FOX Opposition
    x.
    This is the motion that was mooted,
    allegedly because the judge had already made his decision on Thursday, the 8th of July.
    Barb is not so sure.  Electronic notice is usually given the same day or the morning after the decision is made.
    Here the notice was not sent until after the weekend, on Monday, the 12th of July.
    On Friday, July 9th, I received this opposition.  Only one line is important: "Plaintiff's vitriol and ad hominem attacks notwithstanding, it is clear that Plaintiff has long since departed from the fundamental legal issues raised in this Court's original order of dismissal."
    Barb says,  It was the Brown Rudnick attorneys -- Ritvo, Hermes, and Gerlovin -- who introduced clearly fabricated documents to support their opposition and called a statute an enabling statute when it was not.   That opened up a can of worms.   Should they really be surprised that Barb took the time to empty the can on their laps?
    What is tragic is, The Judge appears not to have cared.  He denied Meuse's motion to reconsider apparently on Thursday, July 8th, but notice was -- and this is UNUSUAL -- not sent until Monday, July 12th.  Well, it saved Barb from having to write another reply to a nasty opposition.
    The judge's decision follows.
    The state law claims of STF/AMW, FOX TV
    are transferred to Essex County Superior Court
    The judge did similarly for NCMEC.
    Its state law claims also are transferred
    to Essex County Superior Court at Lawrence
