#159a, Drano Series

Some Surprises on the Docket Sheet of
Barb's Appeal of Justice Spina's Judgment of Disbarment
to the
Full Panel of the Massachusetts
Supreme Judicial Court
~~~~~~~~~
There are two documents in this file:
One, the cover letter to the Clerk.
The other, Barb's appellate brief.
~~~~~~~~~
NOTE that Drano ##159, 160, and 161 were sent to the
Massachusetts Supreme Judicial Court for the Commonwealth, where the full panel (minus the judge who sat in the single-justice) will hear the case.
~~~~~~~~~~~~~~~~~~
NOTE that Drano ##162, 163, and 164 were sent to the
Massachusetts Supreme Judicial Court for Suffolk County, where every month a different SJC justice is assigned to sit as a  judge  in the single-justice session.
Amongst the many types of cases heard by a "Single Justice" are petitions invoking the "SUPERINTENDENCY" of the SJC and
Board Discipline cases.
~~~~~~~~~

People have written me, "What can I do to help you?"
It is unlikely anything will help the inevitable,
however, anything is worth trying.
The "anything" might be letters to the Court:

Keep the letters going to the Court.

I was there on October 6th to file my appeal.   One of the clerks said the letter file was a few inches thick.

Whether the judges will ever read them is unknown, but they are sure to know that they are there.
I'll inquire as to whether a "reader" has been assigned.

Let's also try emails.  The judges' secretaries will certainly let them know how many are coming in.

Daniel Crane had been Bar Counsel. the head of the Office of Bar Counsel ["OBC"}, allegedly the private prosecutorial arm of the SJC.  He was also the titular plaintiff of the petition against Barb.   The Board of Bar Overseers ["BBO"}is the private adjudicatory arm.  That Crane is listed on the SJC website as being "with" both the OBC and the BBO shows that the plaintiff, the prosecutor, and the "judge" are one and the same.  What do you think of that as a separation of powers?  Appearance of impropriety?  Conflict?

Go to the docket sheet of Barb's appeal:

Susan Strauss Weisberg has been the OBC prosecutor, an employee of allegedly the OBC, the private prosecutorial arm of the SJC.   That Weisberg is listed on the SJC website site as being with the BBO shows that the prosecutor and the "judge" have the same "boss"!  Do you find a problem with that?

The Massachusetts Supreme Judicial Court admits
it is an "Other interested party" in Johnson's case!

Supreme Judicial Court for the Commonwealth
Other interested party

Barb will be filing a Motion to Supplement Issue 10 of her appellate brief to the full panel
 rather than a Motion to Disqualify the SJC from hearing her disbarment appeal.
This is just more evidence of a conflict of evidence.
How may the Court hear it if it is a party?
How about a trial de novo in front of a jury?!!
